What is Rape?

Engaging in sexually behaviors is considered rape if:

  • It is done by force
  • The threat of force prevents an individual from resisting
  • The plaintiff is unconscious or is known to be unaware of what is being done to his/her body
  • The person substantially impairs the individual’s ability to control his/her actions by giving the individual drugs or intoxicants without his/her knowledge in an attempt to prevent resistance
  • The individual suffers from a mental disability that makes them unable to give consent

What are the penalties for Rape in Pennsylvania?

In Pennsylvania, rape is considered a felony of the first degree and is punishable with up to 40 years in prison. However, there are more severe penalties if it is the rape of a child or if it is rape of a child with serious bodily injury.
