What is Burglary?
Burglary is a when a person enters a building and or home with intent to commit a crime. It is important to note that Burglary takes place when the building or home is occupied by persons or could potentially be at any given time. It is considered a felony, especially when there is intent or bodily injury is committed against a person in said building, such as assault, kidnapping, or sexual acts. The defendant will only be charged with multiple crimes if the second crime committed with burglary is considered a felony. The penalty for burglary could be up to twenty years in Pennsylvania. In the second degree, this crime committed would be up to ten years in prison.
Defenses used against Burglary:
- If the building is considered to be abandoned
- if the structure is opened to the public, or public property at time of crime
- the perpetrator is allowed to enter the building/home
One can also be charged with intent to use burglary tools. So if you are found with tools to support your crime, you could either be fined or sentenced to jail time.
