It is essential that, if you have been charged with a second or third DUI, you are aware of Chester County’s RPP program and how having an experienced attorney is essential to a successful outcome of your case.

Chester County’s RPP Program: An Overview

The Chester County RPP program is an alternative sentencing program designed to reduce the amount of jailtime the defendant has to serve. An individual will most likely be eligible for the RPP program in Chester County if there are no factors that would exclude them for eligibility. Factors that prevent RPP eligibility include:

  • An individual suffering a serious injury at the time of the offense,
  • The defendant has a prior history of violent behavior,
  • The defendant violated their probation or parole,
  • A minor being present in the car at the time the offense was committed.

It is also important to note that, even if an individual is eligible for the RPP program, the Court can still exercise its discretion and deny the individual the privilege of being accepted into the program.

Chester County’s RPP Process

The process begins when the defendant files the RPP application with the Chester County Probation and Parole Department. The filing of the RPP application MUST be done within 30 days of the defendant’s sentencing. Generally, Chester County’s RPP dispositions include:

  1. a flat period of incarceration,
  2. fines and costs,
  3. electronic monitoring,
  4. intensive probation supervision,
  5. community service,
  6. drug and alcohol treatment.

If and when the defendant is permitted admission into the RPP program, they will subjected to a period of house arrest after their incarceration. While on house arrest, the individual will only be permitted to leave the home for court permitted activities such as work, doctor’s appointments, court permitted functions etc. The individual must also have a working telephone line in their dwelling and will be required to report in on a weekly basis.
