In October of 2020 Vincent J. Caputo, Esquire was introduced to a Defendant who was facing charges in Delaware County for 1 count of possession of a controlled substance and 2 counts of possessing a controlled substance, or contraband as an inmate. This young man attempted to sneak a controlled substance pill into the Delaware County prison during his weekend stay and was suddenly facing years inside of a state prison.

With the original charge of controlled substance contraband to confined persons, the Defendant was facing a mandatory minimum sentence of two years’ incarceration. With a specialized strategy, Mr. Caputo, the District Attorney, and the presiding judge compared and contrasted possibilities of sentences. The District Attorney was adamant about the Defendant serving a mandatory two-year sentence inside of a state prison. Mr. Caputo managed to persuade the judge to agree to a plea negotiation for the defendant with a sentence of five years’ probation and two-hundred and seventy days of home confinement in lieu of any jail time at all.

Originally, facing this charge, the defendant could have served the mandatory sentence, which was a minimum of two years imprisonment. With the advocacy of Mr. Caputo, the defendant managed to evade any imprisonment all together and was sent home with five years of probation, starting with two-hundred and seventy days of home-confinement.
